Amy’s Kitchen, Inc. (“Amy’s”) values your privacy. We’ve worked hard to build your trust, and we’re committed to keeping it that way. This Privacy and Cookie Policy (“Policy”) explains how Amy’s will use any information we may collect from you when you visit Amys.com (the “Website”). This Policy applies only to information collected by our website and not to outside websites that you might visit by following links from our pages. We encourage you to review each third-party website’s privacy policies before disclosing any information to that site.

Amy’s collects information from you on its websites in two ways: 1) Personal Information provided by you on the Website, 2) through the use of cookies and other tracking technologies, and 3) when you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy. For purposes of this Policy, “Personal Information” means any information that identifies, relates to, describes, is capable of being associated with, or could reasonable be linked, directly or indirectly, with a particular identified or identifiable natural person (’data subject’); an identifiable natural person is one who can be identified, directly or indirectly, by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

1. What information does Amy’s collect?

a. Information That You Provide to Amy’s Directly

The information we collect from you on the Website may include:

  • Contact Us: If you wish to send us a message on our “Contact Us” page, we will request certain information from you, such as first name, last name, mailing address, email address, phone, and location. Similarly, if you contact our Consumer Relations team by phone, we may keep notes, a recording, or a transcript of your call with our team for quality assurance purposes.
  • Where to Buy: If you wish to locate a retailer that sells Amy’s products near you, you may provide your location information, such as city, state or zip, or you may use our “Find my Location” service which uses your device’s precise geolocation data if you grant access to it in your device’s settings and/or IP address.
  • Newsletter Sign-up:  Amy’s has an electronic newsletter and may launch other electronic communications in the future. Newsletter recipients may, from time to time, receive coupons for discounts on Amy’s products. In order to receive these communications, we will request certain information from you, such as name and email address. You may choose not to receive marketing emails by clicking the “Unsubscribe” link in any of the emails we send. Even if you unsubscribe, we may send you non-marketing email in response to consumer inquiries.
  • Send Us a Love Letter: If you wish to send us a message about an Amy’s product or Amy’s in general, we will request certain information from you, such as first name, last name, email address and your message. There is also the ability to upload an image to send with your message, which is optional. You have the option to select “Yes” to use of your comments on Website or other Marketing collateral.
  • Promotions and Surveys:  From time to time, we may offer you the opportunity to participate in a promotion, contest, sweepstakes, giveaway, survey, or similar opportunity on our site. If you choose to participate, we will request certain Personal Information from you, such as contact and demographic information.
  • Careers at Amy’s: If you wish to apply for a position at Amy’s through the Website, we will request certain information from you, including first name, last name, email address, and phone number to create an account through our talent acquisition vendor, iCims. iCims is committed to protecting Personal Information from security threats.   • Other Information: We may also collect personal information about you through our social media pages (for example, if you post a comment to our page or account). We may collect certain metadata associated with information you share, such as location, date/time stamp, or device type. If you have also provided your email address associated with your social media account(s) to Amy’s, such as for our Newsletter Sign Up, your social profile may be associated with you in our databases. Each social media platform maintains its own privacy policy; please refer to those policies for more information on the information the platform may collect from you.

All of the information you provide to us in connection with the above features of the Website is voluntary on your part. You do not need to send us any information to use our website. However, if you elect to participate in any of the above programs, you will need to provide us with the applicable information. As detailed below, we will not use the information you provide for any other purposes or allow third parties to use such information for their own use, except to provide services you requested on our website, or as required by law.

b. Other Ways We Collect Information from You

When you visit the Website or our communications, we, our service providers, and third party partners may automatically collect certain information about your usage or device by automated means or by using technologies such as cookies, web beacons, or other tracking technology.

  • Cookies are small text files that are stored locally on your device by websites that you visit. They are widely used in order to make websites work, or work more efficiently, as well as to provide information to the owners of the site. The information that may be collected through automated means, including cookies, includes:
    • Recording and remembering your consent to cookies and other tracking technology
    • IP addresses and other details of devices you use to connect with Amy’s
    • Details about your interaction with the Website, social media platforms, or other connected services
    • Operating, evaluating, and improving our business, our websites, and other products and services we offer

  • Web beacons (also known as clear gifs and pixel tags), which are small electronic files that are embedded invisibly in image files within webpages or HTML formatted emails allow us to anonymously track the online usage patterns of our users and to track when and which emails we send you are opened. We may use pixels to collect information about your interactions with our email messages, such as the links you click on and whether you open or forward a message, the date and time of these interactions and the device you use to read emails.
  • Analytics tools, which collect information sent by your browser that lets us know which pages you visit on our website. You may opt out of this tracking here: http://tools.google.com/dlpage/gaoptout/. We do not link non-Personal Information with Personal Information. We use this non-Personal Information in an aggregate way to monitor usage and improve our website. These tools do not contain any personally identifiable information, such as your name or email address.
  • Heat mapping and recordings (Crazy Egg, Inc.) services are used to display the areas of a page where users most frequently move the mouse or click. This shows where the points of interest are. These services make it possible to monitor and analyze Web traffic and keep track of user behavior.  Crazy Egg does not collect end users’ personal information; all IP addresses and user information is anonymized. Neither Crazy Egg nor we will ever use this information to identify individual users or to match it with further data on an individual user.

  • Information We Collect from Other Entities: We also collect information from other sources such as our data analytics service providers and advertising providers. We may combine this information we receive from and about you on- and offline, including personal and non-personal information collected through the Website, to help us tailor our communications to you and improve our Website and services we offer.
  • Information Collected from Third-Party Platforms: If you communicate with us through or mention us on a social media or other third-party platform, we may collect information about you, such as the communications, your name, your username associated with that platform and any information or content you have permitted the platform to share with us. The platform provider’s privacy policy will apply to your interactions with the platform and its collection, use, and sharing of your personal information, including when you interact with pages that we maintain on social media platforms. We will treat such personal information about you that we receive from such platforms as described in this Policy. You should check your privacy settings in your social media or other third-party accounts to understand what information is sent to us through these services and how to restrict it if you wish.

2. How We Use Your Information

Amy’s uses the information you provide or that we collect to monitor, improve, and develop new products and services and to improve your experience on the Website, social media, and other platforms.  Examples include:

  • Monitor and improve website performance and security;
  • Provide you with customized content, targeted offers, and advertising on the Website, other sites, or via email, as permitted by law;
  • Associate your activities, customize content, or tailor advertising across different devices and browsers that you use to access the Website or services we offer;
  • Provide you with information or services you request;
  • Respond to your requests, questions, and comments;
  • Offer and administer promotions, sweepstakes, and contests;
  • Conduct research of site visitors for use in our business and product planning and improvements;
  • To create a profile about a consumer reflecting the consumer’s preferences, characteristics, trends, predispositions, or attitudes;
  • Generate anonymized data for further data analytics;
  • Accept and evaluate job applications submitted through our recruiting portal
  • Improve our overall service to you; and
  • Comply with legal requirements, industry standards, and our policies.

Amy’s will at no time use your Personal Information for any other purposes or allow third parties to use your Personal Information for their own use, except to provide services in accordance with this Policy, or as required by law.  We DO NOT link aggregate user data with personally identifiable information.  

3. How We Share Your Information

We may share Personal Information with trusted parties, such as service providers who assist us in our business and who are only permitted to use your information in ways we have authorized or to comply with legal requirements. These trusted parties include:

  • Our subsidiaries and affiliates;
  • Trusted business partners, such as companies we partner with for joint projects or promotions, and service providers, to perform a business, professional or technical support function for us;
  • Advertising partners to display more relevant advertising and to manage our advertising on other sites;
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request;
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Amy’s, our customers, or others;
  • As necessary if we believe that there has been a violation of the Website’s Terms of Use or of our rights or the rights of any third party; and
  • We may also disclose your Personal Information with your express consent.

4. How We Protect Your Information

We take precautions to protect your Personal Information once we have it. We have measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure.  Information you submit to Amy’s is encrypted.  All Personal Information you provide us is stored on secure servers behind firewalls. However, the transmission of any information via the internet is not completely secure. Although we do our best, security risk is inherent in all internet and information technologies and, therefore, we cannot guarantee the security of your information transmitted through the Website.

5. Links to Other Websites

This website contains links to other sites, such as Facebook, Twitter, and other third parties, that are not owned or controlled by Amy’s Kitchen. Please be aware that we are not responsible for the privacy practices of such other sites.  We encourage you to be aware when you leave our site and to read the privacy policies of such other sites so that you understand what Personal Information is being collected from you and how it will be used.

Our Website may also have “plugins” (such as the Facebook “Like” button) to third party sites or offer login features (such as login with Facebook) through a third-party account. Third party plugins and login features, including their loading, operation and use, are governed by the privacy policies and terms of the third parties providing them.

6. Children

Our website is not intended for use by children under the age of 16. We do not knowingly solicit or collect Personal Information from children under 16. In the event we learn that we have collected Personal Information from a child under 16 years old without verification of parental consent, we will delete that information as quickly as possible. 7. International Data Transfers

We are headquartered in the United States and may from time to time have service providers who operate in other countries. Your personal information may be transferred to or from the United States or other locations outside of your state, province, or country where privacy laws may not be as protective as those where you live.

8. Your Choices

  1. Privacy Rights. See the State Law Privacy Rights section below for information on rights that privacy laws in certain states grant to their residents.
  2. Opt Out of Marketing Communications. You may request to opt out of marketing emails by following the unsubscribe instructions at the bottom of any email you receive from us, or by sending your opt out request to privacy@amys.com. After opting out of marketing emails, you may continue to receive service-related or other marketing communications, including notices of any updates to our Terms of Use or Privacy Policy.
  3. “Do Not Track” Notice. Some browsers offer a “Do Not Track” feature that lets you tell websites that you do not want to have your online activities tracked. We do not respond to these “Do Not Track” signals. We do not track your Personal Information about your online activities over time and across third party websites. We also do not authorize third parties to collect any Personal Information from you on the websites for these purposes.
  4. Cookies. Most browsers let you remove and/or stop accepting cookies from the websites you visit. To do this, follow the instructions in your browser’s settings. Many browsers accept cookies by default until you change your settings. If you do not accept cookies, however, the Website may not work properly. 9. Privacy Rights Under Certain State Laws

Scope. Except as otherwise provided, this section applies to residents of California, Virginia, Colorado, Connecticut, and other states where privacy laws applicable to us grant their residents the rights described below.  

For purposes of this section, “personal information” has the meaning given to “personal data”, “personal information” or similar terms under the applicable privacy laws of the state in which you reside.  Please note that not all rights listed below may be afforded to all users and that if you are not a resident of the relevant states, you may not be able to exercise these rights. 

In some cases, we may provide a different privacy notice to certain categories of residents of these states, in which case that notice will apply with respect to the activities it describes instead of this section.  

Your Privacy Rights. You have the rights listed below. However, these rights are not absolute and in certain cases, we may decline your request as permitted by law.  

  • Information/Know. You can request to know whether we have collected your personal information, and in certain cases, information about how we use and share it. For example, if you are a California resident, you can request information about the categories of personal information that we have collected; the categories of sources from which we collected personal information; the business or commercial purpose for collecting, sharing and/or selling personal information; the categories of any personal information that we sold or disclosed for a business purpose; and the categories of any third parties with which personal information was sold, shared or disclosed for a business purpose.
  • Access. You can request a copy of the personal information that we have collected about you.
  • Correction. You can request that we correct inaccurate personal information that we have collected about you.
  • Deletion. You can request that we delete your personal information. Once we process a deletion request, we will be unable to provide any online or digital services to you or support for past products or services that you may have purchased.
  • Opt-Out. 
    • Opt-Out of Processing for Targeted Advertising Purposes. You can opt-out of processing of personal information for targeted advertising purposes.   
    • Opt-Out of Sales of Personal Information. You can opt-out of “sales” of your personal information as defined in applicable privacy laws. Note that Amy’s does not sell or share personal information; however, you may submit a request to opt out for any future change to our practices.
    • Opt-Out of Profiling. You can request to opt-out of the processing of personal information for the purposes of “profiling” as defined in applicable privacy laws, which may include processing that will have a legal or similarly significant effect on you or automated processing to analyze or predict your interests or other behavior.
  • Nondiscrimination. You are entitled to exercise the rights described above free from discrimination as prohibited by applicable privacy laws. 

How to Exercise Your Rights. 

  • Information/Know, Access, Correction, and Deletion. You may submit requests to exercise these rights by calling us toll free at 1-800-643-0570, or via email to privacy@amys.com. You may also submit access and deletion requests here.  We cannot process your request if you do not provide us with sufficient detail to allow us to understand and respond to it.   
  • Opt-out of Processing for Targeted Advertising Purposes.  Like many companies, we use services that help deliver interest-based ads to you. You can submit requests to opt-out of processing of personal information for targeted advertising purposes here: Your Privacy Choices. If you transmit a legally recognized browser-based opt out preference signal from your browser, we recognize such preference as a request to opt-out of processing of personal information for targeted advertising purposes to the extent required by applicable law.
  • Verification of Identity. We may need to verify your identity to process your information/know, access, correction, or deletion requests and we reserve the right to confirm your residency. To verify your identity, we may require authentication into your Service account, government identification, a declaration under penalty of perjury, personal identifiers we can match against information we may have collected from you previously, confirmation of your request using the email address or telephone number associated with your account, or a declaration under penalty of perjury, where permitted by law.
  • Authorized Agents. Your authorized agent may be able to make a request on your behalf.  However, we may need to verify your authorized agent’s identity and authority to act on your behalf.  We may require a copy of a valid power of attorney given to your authorized agent pursuant to applicable law. If you have not provided your agent with such a power of attorney, we may ask you to take additional steps permitted by law to verify that your request is authorized, such as by verifying your identity directly with us, providing proof that you have given the authorized agent signed permission to submit the request, and directly confirming with us that you gave the authorized agent such permission.
  • Appeals.  If we deny your request to exercise your privacy rights, you can appeal the denial through the same mechanism this Privacy Policy designates for the submission of the relevant request.

We may need to change this Policy from time to time. When we do, we will post the new Privacy Policy at amys.com and changing the effective date listed at the top of this Privacy Policy. Your continued use of this website, after the effective date of the change notice, will mean you accept any such changes. To ensure you are reviewing the most current version of this Policy, we will post the effective date at the top of the page.
